Competition terms

  1. This competition is open to citizens of the Republic of South Africa aged 18 years or over, except for employees or officers of African Chic Design CC  (“Africhic”) or Quirk eMarketing (Proprietary) Limited (“Quirk”), their families or anyone else associated with this competition. To be eligible to win the Quirk internship, entrants must further be willing and able to relocate to either Johannesburg or Cape Town at their own expense for a period of no less than 12-months.
  2. By entering the competition, the entrant warrants that all information submitted by it is true, current and complete. Africhic and Quirk reserve the right to verify the eligibility of all entrants.
  3. All information detailing how to enter this competition forms part of these terms and conditions. It is a condition of entry that the entrant agrees to abide by these terms and conditions. Submission of an entry will be taken to mean acceptance of these terms and conditions.
  4. The competition is organised by African Chic Design CC of 18 Roeland Street, Cape Town 8001.
  5. Africhic reserves the right to cancel or amend the competition or these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside Africhic’s reasonable control. In the event of the same or similar circumstances as aforesaid arising, Quirk shall further be entitled to remove or amend the conditions relating to its provision of the Quirk internship as a prize. Any changes will be posted either within these terms and conditions or on the Africhic website.
  6. In the event of any dispute regarding the terms and conditions, conduct, results and all other matters relating to this competition, the decision of Africhic shall be final and no correspondence or discussion shall be entered into, except that in the event of any dispute relating to the awarding of the Quirk internship shall be determined by Quirk, which determination shall likewise be final and no correspondence or discussion shall be entered into.
  7. Africhic and Quirk each reserve the right to disqualify any entrant if either of them has reasonable grounds to believe the entrant has breached any of the these terms and conditions.
  8. Entries must be in JPEG format (72 dpi, 1024 pixels screen resolution) and should be submitted via email to info@africhic.com or delivered on CD-Rom to Sylvia Gruber at Africhic.com, 18 Roeland Street, Cape Town 8001. Entries must be labeled with the entrant’s name. Entrants should include their own name, address, telephone number and email address.
  9. All entries must be received by no later than 12pm on 30 September 2010. 
  10. All entries submitted must be the sole work of the individual submitting them and must not have been, in whole or in part, published elsewhere or submitted to any other person or party. Where an image includes a photograph or other representation or likeness of any person, a full and proper written release and assignment from that person must have been obtained in favour of the entrant in respect of that person’s right, title and interest therein.  It is the responsibility of each entrant to ensure that any and all images, copy, text, design, formatting and other data and/or material that they submit do not infringe any laws, or any intellectual property rights (including without limitation copyright, design rights, trade marks and/or moral rights) or other rights or interests of any kind of any third party. Furthermore, entrants must ensure that entries do not infringe the privacy or any other rights of any third party, and do not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening. Entrants warrant that the entry they are submitting is their own work and that they own all rights (including but not limited to all intellectual property rights of any nature mentioned above or otherwise) and interest in it. 
  11. Subject to the provisions set out below, all rights in entries submitted for this competition remain with the respective entrants. However, in consideration of Africhic and Quirk providing the competition, each entrant grants a worldwide, irrevocable, perpetual licence to Africhic and Quirk to feature any or all of the submitted entries, in whole or in part, in any of their published materials, their websites and/or in any promotional material connected to this competition. The entrant who submits the winning entry further irrevocably, fully and finally agrees to cede and assign, with effect from the date on which the entrant is adjudged to be the winner, all right, title and interest in and to the relevant entry to Africhic in consideration of which the entrant will be entitled to receive the prizes as advertised. 
  12. Late, illegible, incomplete, defaced or corrupt entries will not be accepted. No responsibility can be accepted for lost entries and proof of transmission will not be accepted as proof of receipt. Entries must not be sent through agencies or third parties. 
  13. The winning entry will be that that is judged in accordance with the judging criteria set out above. The winner will be notified within thirty days of the closing date of the competition.
  14. The winners may be required to take part in publicity.
  15. All prizes are non transferable and there are no cash alternatives. 
  16. The Africhic shopping voucher expires 31st of March 2011 and can be used either entirely for 1 shopping trip - or be split at your convenience into 2 shopping trips. The unused amount will be credited to your online account. The voucher cannot be used for discounted items. 
  17. The Quirk internship is paid and is subject to the winner agreeing to a 12-month internship with Quirk for a period of no less than 12-months in accordance with and subject to Quirk’s standard internship agreement, as updated from time to time.
  18. Neither Africhic nor Quirk accepts any responsibility for any damage, loss, expense, claim against, injury or disappointment suffered or incurred by any entrant entering the competition or as a result of accepting (or not accepting) any prize. Neither Africhic nor Quirk is responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment or software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination of these, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in the competition. Nothing shall exclude Africhic’s or Quirk’s liability for death or personal injury as a result of their negligence.
  19. South African law applies and the exclusive jurisdiction of the South African courts shall prevail.
